1. Who these Terms apply to
These Terms apply to you if you do any of the following:
- Visit this website, including asking Echo to call you or booking a demo (a "Visitor").
- Create or use an Echo account for your organisation (a "Customer", and each person using it a "User").
If you are a person who received a call or message from an Echo agent acting for one of our Customers, these Terms do not bind you. The Customer that chose to contact you is responsible for that call. The Privacy Policy explains what happens to your data and how to reach us.
By using the website, requesting a call, or creating an account, you accept these Terms and the Privacy Policy. If you do not agree, do not use Echo.
2. Definitions
- Echo or the Service: the Echo platform, including the web app, the API, the voice agents, telephone numbers provisioned through it, the WhatsApp features, and this website.
- Agent: a voice AI configuration a Customer creates in Echo, with its own script, language, voice, knowledge and rules.
- End-Customer: a person an Agent calls, or who calls an Agent, on a Customer's behalf.
- Customer Data: everything a Customer or its Users put into Echo: contact lists, phone numbers, lead details, scripts, knowledge-base files, consent records, suppression lists, CRM credentials and settings.
- Call Content: the audio recording, transcript, extracted fields, scores and summaries of each call or message an Agent handles.
- Credits: prepaid balance, in Indian Rupees, that Echo draws down as the Service is used.
- Applicable Law: every law and regulation that applies to a party's use of Echo, including India's Telecom Commercial Communications Customer Preference Regulations, 2018 (TCCCPR) and their amendments, the Digital Personal Data Protection Act, 2023 (DPDP Act), the Information Technology Act, 2000 and its rules, and the sector rules that apply to the Customer's business.
3. This website and the demo call
3.1 Get a call from Echo
You may ask an Echo Agent to call the mobile number you enter, so you can hear the product. When you do:
- You confirm the number is yours, or that you are authorised to receive calls on it. We verify this with a one-time code sent to that number on WhatsApp before any call is placed.
- You agree to receive one automated call for each request you make. Because you asked for the call, it may be placed outside normal commercial calling hours. It is not a commercial call made without your request.
- The call is made by an AI Agent, not a person. It is recorded, transcribed and scored, exactly as calls on the Echo platform are. The agent will tell you it is an automated assistant if you ask.
- We may use the call and the details you entered to follow up with you about Echo. You can tell us to stop at any time.
The demo call is a preview. It creates no obligation on either side, and the numbers, scripts and outcomes shown on this website are illustrations unless marked otherwise.
3.2 Book a demo and Ask Echo
Booking a demo sends us the details you type so we can contact you. "Create an agent now" passes what you type to the Echo sign-up page in the address bar; nothing is sent until you choose to continue.
3.3 Rate limits and misuse
We limit how often a number can be verified or called, and we may refuse or block requests that look automated, abusive, or made for numbers that are not yours. Requesting a call to a number you are not entitled to use is a breach of these Terms.
4. Accounts and eligibility
- Echo is for business use. You must be at least 18 years old and act for an organisation that you are authorised to bind. We do not offer Echo to consumers.
- You must give accurate registration and billing details and keep them current.
- You are responsible for everything done under your account, including by Users you invite and by systems you connect through API keys. Keep passwords and API keys secret, use the roles Echo provides to limit what each User can do, and tell us at once at client@comsync.in if you suspect unauthorised access.
- You may not create an account if we have previously suspended or closed one of yours for breach.
5. What Echo does, and does not do
5.1 What Echo does
- Places outbound calls and answers inbound calls with AI Agents you configure, in the languages Echo supports, over telephony providers you choose.
- Records, transcribes and scores each call, extracts the fields you ask for, and writes results to your CRM, webhooks or API.
- Screens every dial against the DND and suppression lists you upload, enforces the calling windows you switch on, stores the consent records you capture and enforces them when you switch enforcement on, and keeps an append-only audit of every allow and block decision.
- Provides Quality Lab and evaluation tools to test Agents before and after launch.
5.2 What Echo does not do
- Echo does not register you, your headers or your templates on the DLT (Distributed Ledger Technology) platforms that telecom operators run, and does not communicate with operator blockchain portals.
- Echo does not supply a DND database or a scrubbed calling list. It screens against the lists you provide.
- Echo does not obtain consent from End-Customers for you. It stores and enforces the consent records you capture.
- Echo does not give legal, financial or regulatory advice. The controls it offers help you comply; whether a calling programme is lawful is your decision.
5.3 AI output
Agents generate speech in real time from language models. They can mishear, misunderstand, or say something inaccurate or off-script. Transcripts and extracted fields are machine-generated and may contain errors. You are responsible for testing Agents before launch, for monitoring them in production, and for any decision taken on the basis of Call Content. Do not rely on an Agent for anything where an error could cause serious harm.
6. Your calling obligations
Phone calls to the public are closely regulated in India and elsewhere. When you use Echo to contact End-Customers, you alone are the sender of those communications, and you agree that:
- Consent and lawful basis. You will only call or message people you are permitted to contact under Applicable Law, and you will hold a valid, current record of consent or other lawful basis for every number before you load it into Echo.
- TCCCPR and DLT. Where the TCCCPR applies, you will register as a sender on the operators' DLT platforms, register the headers and templates you use, use numbering series the regulator designates for commercial or transactional calls (such as the 140 and 1600 series), honour the National Customer Preference Register (DND), and respect the permitted calling hours. You will upload current DND and suppression lists to Echo and keep them current.
- Recording and AI disclosure. You will ensure End-Customers are told that calls are recorded, where Applicable Law requires it, and you will not configure an Agent to claim to be human, deny being an automated assistant, or impersonate a real person or organisation.
- Sector rules. If you are a lender, collection agency, insurer, broker, educational institution or otherwise regulated, you will follow the conduct rules that apply to you, including those on debt collection, fair practices, outsourcing, and recording retention, and you will configure Agents accordingly.
- Accuracy and content. You are responsible for the accuracy of the contact data, scripts and knowledge you give Echo, and for making sure Agents make no claim you could not lawfully make yourself.
- Complaints. You will handle End-Customer complaints and opt-out requests promptly, add opted-out numbers to your suppression list, and tell us if a regulator, operator or End-Customer raises a complaint that involves Echo.
- Data protection. With respect to End-Customers' personal data you are the Data Fiduciary (or controller) and we act as your Data Processor, as described in section 9. You will give the notices and obtain the consents the DPDP Act and other Applicable Law require.
7. Acceptable use
You will not, and will not allow anyone else to, use Echo to:
- Call or message anyone without a lawful basis, or in breach of a do-not-call list, calling-hour rule or opt-out request.
- Harass, threaten, intimidate, deceive or defraud anyone, including through persistent or repeated calling.
- Impersonate a person, government body, bank, regulator or other organisation, or spoof caller identity.
- Collect payments, credentials, one-time passwords, card details or other sensitive data by voice unless you are lawfully entitled to and have told us in advance.
- Run emergency, life-safety or medical-triage calls, or anything where a wrong answer could cause injury.
- Generate political campaigning, lotteries, adult content or anything unlawful in the jurisdiction of the person called.
- Upload content you have no right to use, or that infringes anyone's rights.
- Probe, scan, overload or interfere with Echo or the networks it uses, bypass rate limits or security, or access another Customer's data.
- Reverse engineer Echo, scrape it, build a competing product from it, or resell it without our written agreement.
- Use Echo in breach of the terms of a telephony, AI or CRM provider it relies on.
We may investigate suspected breaches and may suspend an Agent, a number, a User or an account while we do (section 16).
8. Credits, pricing and payment
- Prepaid. Echo is prepaid. You buy Credits in Indian Rupees and usage draws them down. The current per-minute price and what it includes are shown on the pricing page and, for your account, on your billing page. The price in your billing page at the time of use is the price that applies.
- Metering. Call time is metered from connection to hang-up as shown in your call records. Where Echo passes through a cost from a provider you bring yourself, you pay that provider directly.
- Taxes. Prices exclude GST and other taxes, which are added at the applicable rate. Give us your GSTIN if you want it on your invoice. A tax invoice is issued for each purchase.
- Payment processing. Payments are processed by a third-party payment provider. We do not store card or UPI credentials.
- No refunds once consumed. Credits are non-refundable once consumed. Unused balances roll forward and do not expire while your account is open. If we end your account other than for your breach, we refund the unused paid balance.
- Promotional credit. Credit we grant free, including the balance a new account starts with, has no cash value, cannot be refunded, and we may limit or withdraw it.
- Zero balance. When your balance reaches zero, Agents stop placing and answering calls until you top up. We are not responsible for calls missed because of an exhausted balance.
- Price changes. We may change prices with at least 30 days' notice by email or in the app. The change applies to usage after it takes effect, not to Credits already consumed.
- Enterprise plans. Custom plans, volume pricing and service levels are set out in a separate order form or agreement, which prevails over this section where they differ.
- Disputes. Tell us about a billing error within 30 days of the invoice. Write to client@comsync.in.
9. Customer Data and Call Content
9.1 Ownership and licence
You own your Customer Data and Call Content. You grant us a non-exclusive licence to host, copy, process, transmit and display them only as needed to provide the Service to you, to keep it secure, to meet legal obligations, and as you otherwise instruct. We do not sell them and do not use Call Content to train our own models.
9.2 Roles under data protection law
For End-Customers' personal data, you are the Data Fiduciary and we are your Data Processor under the DPDP Act, and controller and processor respectively under laws that use those terms. We process it on your documented instructions, which these Terms, your Agent configuration and your use of the Service constitute. We will:
- Process End-Customer data only to provide the Service, and not for our own purposes other than security, abuse prevention and aggregate, non-identifying metrics.
- Keep it confidential and protect it with the measures described in the Privacy Policy.
- Engage sub-processors only in the categories listed in the Privacy Policy, under written terms no less protective, and tell you before adding a category so you can object.
- Help you respond to End-Customers' rights requests and to regulators, as far as the Service allows.
- Tell you without undue delay if we become aware of a personal data breach affecting your data.
- Delete or return your data when the agreement ends, as described in section 16.
If your business needs a separate Data Processing Agreement, write to legal@comsync.in.
9.3 Recordings
Echo records every call so that it can be transcribed, scored and audited. Recordings and transcripts are stored in your account until you delete them or your account closes. You decide how long to keep them, within what Applicable Law requires of you. You are responsible for any notice End-Customers must receive about recording.
9.4 Export
You can export leads, audit trails and other data through the app and API while your account is open, and for the period in section 16.3 after it closes.
9.5 Aggregate data
We may produce and use statistics about how Echo is used, such as connection rates and average call length, so long as they identify neither you nor any individual.
10. Telephony, AI providers and integrations
- Telephony. Calls travel over the telephony providers available in Echo, chosen by you. Numbers provisioned through Echo belong to the provider and are allocated to you for use with the Service; they are subject to the provider's rules, including KYC and the numbering regulations of the country concerned. Call quality, connection rates and caller-ID display depend on carriers we do not control.
- Bring your own account. If you connect your own telephony, CRM, messaging or AI-provider account, you are responsible for that account and for your contract with that provider. We act on the credentials you give us and store them encrypted.
- AI providers. Speech recognition, language models and speech synthesis are provided by third-party providers available in Echo at the time, which change as the market does. The categories are in the Privacy Policy. Provider terms may restrict how their output can be used; you agree to those restrictions where we tell you about them.
- Outages. If a provider fails, calls may fail, drop or degrade. We will work around it where we can, but we are not liable for a provider's unavailability.
- Integrations. Data you send to your CRM, webhooks or WhatsApp recipients leaves Echo and is governed by those systems and their terms.
11. Intellectual property
Echo, including its software, models of behaviour, voices we license, designs, documentation and this website, belongs to Comsync and its licensors. These Terms give you a limited, non-exclusive, non-transferable right to use the Service for your business while your account is in good standing. You keep all rights in your Customer Data, Call Content and the scripts you write.
If you give us suggestions or feedback, we may use them without obligation to you. Anything on this website marked as a sample is illustrative and may not be reused as a representation of Echo's results.
12. Confidentiality
Each party will keep the other's non-public information confidential, use it only for the purposes of these Terms, and protect it with at least reasonable care. This covers your Customer Data and Call Content, and our pricing, roadmap, security details and anything marked confidential. It does not cover information that is public through no fault of the recipient, already known to it, independently developed, or that must be disclosed by law, in which case the recipient will give notice where lawful. This section survives for three years after the agreement ends, and indefinitely for personal data and trade secrets.
13. Warranties and disclaimers
We warrant that we will provide the Service with reasonable skill and care. Except for that, and to the extent Applicable Law allows, the Service and this website are provided "as is" and "as available", without any other warranty, express or implied, including merchantability, fitness for a particular purpose, non-infringement, uninterrupted or error-free operation, or that any Agent will achieve a particular connection rate, outcome or accuracy.
In particular, we do not warrant that use of Echo makes your calling programme compliant with Applicable Law. Compliance depends on your consent records, registrations, lists and scripts, which are yours.
Service levels, if any, are those in your Enterprise agreement. Otherwise we aim for high availability but commit to none.
14. Limitation of liability
To the extent Applicable Law allows:
- Neither party is liable to the other for indirect, incidental, special, consequential or punitive loss, or for loss of profit, revenue, business, goodwill or data, however caused.
- Our total liability to you for everything arising out of these Terms and the Service in any twelve-month period is limited to the amounts you paid us for the Service in the twelve months before the event giving rise to the claim.
- We are not liable for regulatory fines, operator penalties or third-party claims that result from your calling End-Customers without a lawful basis, without required registrations, outside permitted hours, or in breach of section 6 or 7.
Nothing in these Terms limits liability for fraud, wilful misconduct, death or personal injury caused by negligence, or anything else that cannot be limited by law.
15. Indemnity
You will defend, indemnify and hold harmless Comsync, its directors, employees and agents against claims, fines, penalties, losses and costs (including reasonable legal fees) arising from: your Customer Data or Call Content; calls or messages you make through Echo; your breach of sections 6 or 7 or of Applicable Law; or a dispute between you and an End-Customer. We will notify you promptly of a claim, let you control the defence where that is reasonable, and cooperate at your cost.
16. Suspension and termination
16.1 Suspension
We may suspend an Agent, a number, a User or an account, with as much notice as is reasonable in the circumstances, if: we reasonably believe it is being used in breach of section 6 or 7; a telecom operator, regulator or provider requires it; it poses a security risk; complaints about it are excessive; or your balance is exhausted. We will lift the suspension once the cause is resolved.
16.2 Termination
- You may close your account at any time by writing to client@comsync.in from the account owner's email.
- Either party may end the agreement on 30 days' written notice.
- Either party may end it immediately if the other materially breaches these Terms and, where the breach can be cured, fails to cure it within 15 days of notice. We may end it immediately for a breach of section 6 or 7, or if required by law or an operator.
16.3 Effect
On termination your right to use the Service ends and Agents stop. You can export your data for 90 days after the account closes, after which we delete Customer Data and Call Content, except what we must keep by law (such as invoices and tax records) or in backups that expire on their own schedule. Sections 8 (amounts owed), 9.1, 11 to 15, 18 and 19 survive termination.
17. Changes to the service and these Terms
Echo changes often. We may add, change or retire features, languages, voices and providers, and we will give reasonable notice of changes that materially reduce what you have paid for.
We may change these Terms. For material changes we will give at least 30 days' notice by email to your account owner or in the app, and post the new version here with a new date and version number. If you do not agree, stop using Echo before the change takes effect; continuing to use it after that date is acceptance. Each version carries a version number so the wording in force on a given date can always be identified.
18. Governing law and disputes
These Terms are governed by the laws of India. The courts at Delhi, India have exclusive jurisdiction over any dispute arising from them or from the Service, subject to the following: before starting proceedings, each party will raise the dispute in writing and the parties will try in good faith to resolve it within 30 days through their senior representatives. Nothing prevents either party seeking urgent injunctive relief in any competent court.
19. General
- Entire agreement. These Terms, the Privacy Policy, and any Enterprise order form are the whole agreement about Echo and replace earlier discussions. Where they conflict, the order form prevails, then these Terms, then the Privacy Policy.
- Notices. We will notify you at the email on your account. Notify us at the addresses in section 20. Notices are effective when sent, unless a bounce is received.
- Electronic agreement. Accepting these Terms by ticking a box or using the Service is a valid signature under the Information Technology Act, 2000.
- Assignment. You may not assign these Terms without our written consent. We may assign them to an affiliate or to a successor in a merger, acquisition or sale of the Echo business, with notice to you.
- Force majeure. Neither party is liable for delay or failure caused by events beyond its reasonable control, including carrier or internet failures, power cuts, regulatory action, strikes, epidemics and natural disasters, except for payment obligations.
- Severability and waiver. If a provision is unenforceable, the rest stands. Not enforcing a right is not a waiver of it.
- Relationship. The parties are independent contractors. Nothing creates a partnership, agency or employment.
- Export and sanctions. You will not use Echo in breach of export-control or sanctions laws.
